This may not be the typesof complaints people are used to seeing but
here it goes

I own a bubble game its honest and its a good one

i launched it just awhile ago under the name BUBBLEMANIA

i got accused of theft and edited the settings file and the bubble got prematurely restarted because ihad thought it was the right thing to do

without any proof other then the fact that i chose a similar background colour and
i chose to call my bubble game bubblemania i got accused of theft

ITS A FALSE ACCUSATION AND I TAKE EXCEPTION TO THAT

i have however seen people using my "pop bubbles here" banner for other programs such as quicker clicker bubbles and egoldbubbles

just to name a few ITS MY BANNER SERVER OF MY SERVER IT CAN BE PROVEN and i have said nothing

why? becuase a banner with bubbles in the background and with the words "pop bubbles here" on it is not particularly original

myonlyproblem is people using my bandwidth so that can be easily fixed i can change the name of the banner and they won't have a banner anymore

.. okay back to my conclusion

out of curiosity since bubblemania just poped in myhead an i liked the backgorund for the type of site it was egold is gold .. well then a gold bckground is sort of obvious not to mention there are a lot of other bubble sites out there with that colour and that is not theft

neither is using the name bubble mania

for the last 24 hours i decided to search and see if there were any other bubble games with the name bubble mania

it started because i saw one on askmilklys server called bubblemania

yup
so i looked for more

my conclusion i was wrong i should not have changed the name as it was not theft

and if follows suit that the person who called their bubble bubblemania FIRSTT was in fact NOT THE PERSON WHO ACCUSED ME THEFT but was an owner of a bubble game BUBBLEMANIA on askmilky space

so when i reset the game (last time i reset it prematurely and i think i missed one person as refund or they were just mad they didn't get profit or didn't look for the refund and i got a grr smiley)

the site will go back to its orinigal name BUBBLEMANIA

AND IF THE PERSON ACCUSING ME OF THEFT WOULD CARE TO PROVE TO ME THAT IT IS THEFT ..

and THEN PROVE THAT THEY HAVE NOT THEMSELVES STOLEN THE NAME FROM THE ASKMILKY BUBBLE

please provide your proof here because you cannot prove what is not true YOU ARE NOT THE ORIGINATOR OF THE NAME BUBBLEMANIA

and it was not stolen from you

BUT?? possibly did you steal it from one of the other bubblemania owners

have doubt i can showyou a bubble list

here with two bubblemanias on it and ONE IS NOT YOURS that is what started me thinking!

http://money-master.biz/newbubble.htm
here is the first list PROVE TO ME YOU DID NOT STEAL FROM THE OTHER BUBBLEMANIA BUBBLE PLEASE
then retract your FALSE ACCUSATION OF THEFT

when the game restarts i will be returning to its original name because I THOUGHT OF IT ON MY OWN and my bubble site will remain the same colour BECAUSE I THOUGHT OF IT ON MYOWN

the end!

Hello, 1st let me say that I'm on noone side here... however I wish to comment on this because I found out a couple of months ago the same thing for me except it isn't over a program name but My legal business name.... anyways, the law states that in cases like this the governing authorities would look at who has been using the name the longest and they would be the ones to unoffically control the trademark in this type of situation. They then could charge for the second person to use the name in royalities etc... The way to find out if you are trademarked is to do a trademark search, to find a good site to do it just go to any search engine and type in the name trademark and then there will be alot of companies that can do it, not all are free however alot are... I don't agree with two sites using the same name howevr if you have registered your name (eg your domain name) as BUBBLEMANIA, then there isn't any way that a domain registeration company would had let two sites be of the same name, so I would suggest for you to get that name registered with a legit registerar so that you can keep that name if that is in fact what you want... that way that other person can't come back and say that its theirs because you had registered it and they would have to deal with someone else on that issue... other than that let'em talk....lol.

I saw another bubble site called Magic Bubble, which was released after mine as well.

They may have thought of it on their own too, but I did my due diligence by searching before I decided on my name. ab.gif

its not a trademark site
so really right now
no one stole anything
it just bugs me

seeing as ITS NOT A TRADMARK NAME lol

Actually, just like copyrights you can own a trademark simply by creating and using a name. However, if it's not registered it won't get you far. You can put the tm symbol next to the name though, just not the lil r in the circle until you're registered. Might be an idea to keep people from taking the name....
