You have it right, SuperFly.
It is in the TOS of most programs; that you may also receive nonpaid emails and some programs that come out, in marketing themselves, say they will not send you nonpaid emails.
Spamming?
Not as long as you are a member of said program.
Most of my experiances, including Tombmailer, were not that bad at all, not "out of control" spamming; just the occasional informational or promotional kind.
Sending info on advert prices, for example.

Nice lady once you get to know her.
I am not an apologist for her; unsubscribed at about $2.50 when the payout went from up from 5 to 7 dollars.
It was her right to do that; "subject to change" (in TOS) and I respect that.
Besides if one becomes too attached to a program, just for the money, well, I won about 60 bucks Cdn over the weekend, on two hockey bets LOL.
I am into the promotional assets that a program offers and then funnel all earned adverts to a reputable and stable program; ie. one that does not change it's TOS every week; whether in payout amount or in oversending nonpaids.
Well, that is my strategy, anyway.
